Terms of Service

Last updated: September 19, 2026

1. Agreement

These Terms govern your access to and use of AtmoDeck, the desktop weather broadcast software, its installers, updates, documentation and license servers (together, the "Software"), provided by AtmoDeck ("we," "us"). By purchasing a subscription, installing the Software or using it, you agree to these Terms. If you accept on behalf of an organization, you confirm you have authority to bind it. You must be at least 18 years old.

2. Subscriptions & Billing

AtmoDeck is licensed on a subscription basis, billed monthly or yearly as selected at checkout, at the price shown at checkout plus any applicable taxes. Payments are processed by Stripe. Subscriptions renew automatically until canceled. New subscriptions may begin with a free trial (currently 7 days). A trial is free of charge only if you cancel before it ends; if you do not, your payment method is charged the price shown at checkout when the trial ends and the subscription continues. Free trials are limited to one per customer and we may refuse or end a trial we reasonably believe is being abused. We will give notice before any price change takes effect on your subscription.

You can cancel any time from the account page. Cancellation takes effect at the end of the current billing period, and no partial refunds are issued for unused time unless required by law.

If a payment fails, we keep your license working for up to 5 days while the payment is retried. If it is still unpaid after that, the license stops working until the account is brought current.

3. License Grant

Subject to these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and run the Software, for your own organization's use, on up to the number of machines included in your tier. Your selected subscription determines the features available: Map Studio includes Live Map and Archive; broadcast plans include the full suite. The Software is licensed, not sold. You may keep one backup copy of the installer for your own use.

Your license key is personal to your organization. You may not resell it, sublicense it, or share it with anyone outside your organization.

4. An Active License Is Required

  • The Software may be used only while your subscription is active and your license key is valid. Using the Software without an active, valid license is unauthorized use.
  • The Software verifies your license with our servers when it starts and again about every 8 hours while it runs. Each key is limited to the number of machines in your tier.
  • If your internet connection drops, the Software continues to work, for up to 24 hours, on your last successful check. This allowance exists only so that a connection problem does not interrupt a broadcast. It is not a right to keep using the Software after a subscription ends, is canceled, is suspended or is revoked.
  • When your license ends for any reason, you must stop using the Software and uninstall it.

5. Ownership & Protection of the Software

We and our licensors own all rights, title and interest in the Software, including its code, graphics, designs, animations, text and documentation. No rights are granted except those expressly stated in these Terms. Some third-party components in the Software are provided under their own license terms, which apply to those components.

You may not, and may not permit or help anyone else to:

  • copy, upload, publish, distribute, sell, rent, lease, lend, host or otherwise make available the Software, its installer or any part of it, including any modified or cracked version, other than installing it on your permitted machines;
  • steal, extract, or reuse the Software's code, graphics, designs or other assets, or use them in another product;
  • modify, patch, adapt, translate, or create derivative works of the Software;
  • reverse engineer, decompile, disassemble, unpack the Software's application archive, or otherwise attempt to obtain its source code, except to the limited extent applicable law expressly allows despite this restriction;
  • remove, disable, alter, or bypass the license check, activation, machine limit, expiry or any other technical protection, including by using cracks, key generators, license emulators or altered license files, spoofing or altering machine identifiers, or cloning machines to exceed your limit;
  • publish, trade or share license keys, or use a key that was not issued to your organization;
  • interfere with, probe, overload or attempt unauthorized access to our license servers, website or billing systems;
  • remove or alter any proprietary notice or branding in the Software; or
  • use the Software, or what you learn from it, to build or help build a competing product.

Your own settings and content, such as colors, logos, sounds, layouts, cities, counties and camera links, belong to you. Using the Software's normal customization features is not modification of the Software.

6. Enforcement

We use license activation records to enforce these Terms. If we believe a key is being shared, the Software has been tampered with, or these Terms are being violated, we may suspend or revoke the key and terminate your access immediately and without refund. Breach of sections 4 or 5 may also cause us serious harm that money cannot fully repair, so in addition to any other remedy we may seek court orders to stop it, damages, and recovery of our legal costs, and we may pursue claims including copyright infringement and circumvention of technological protection measures, and report unlawful activity to the authorities.

7. Your Responsibilities

  • You are responsible for the accuracy and legality of anything you configure or broadcast with the Software, including alert content, station branding, camera feeds, news feeds and any custom data sources you connect. You must have the rights to display and broadcast any camera, video, image, music or text you use.
  • You are responsible for following the terms of the data providers the Software connects to, such as the National Weather Service, NWWS-OI, Open-Meteo, OpenWeather and any others you configure. Some providers' free services are limited to non-commercial use, and you must obtain any paid plan or key your use requires. Our subscription does not include third-party data or keys.
  • You will keep your license key confidential and tell us promptly if you believe it has been exposed.
  • You will comply with all laws that apply to your use of the Software and your broadcasts.

8. Data Sources & Accuracy

The Software displays weather and alert information from third-party sources (National Weather Service, Open-Meteo, OpenWeather and others you may configure). We do not control the accuracy, availability or timeliness of that data, and it may be delayed, incomplete or wrong. The Software is a presentation tool. It is not an official warning system and must not be your only source of severe weather or life-safety information. Always verify severe weather information through official channels before you broadcast or act on it. We are not liable for broadcast or safety decisions made based on it.

9. Availability & Updates

We work to keep our license and billing services available, but we do not guarantee uninterrupted service. We may update, change or remove features, and may require you to install updates to keep using the Software. Third-party services can change or stop at any time.

10. Termination

You may stop using the Software and cancel your subscription at any time. We may suspend or terminate your access for non-payment, breach of these Terms, or unauthorized use, effective immediately in the case of a breach of section 4 or 5. On termination your license ends and you must stop using the Software and uninstall it. Sections that by their nature should survive termination, including sections 5, 6, 8, 11, 12 and 13, will survive.

11. Disclaimer & Limitation of Liability

The Software is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost broadcast time or lost data, arising from use of the Software, including any error or delay in displayed weather data. Our total liability for any claim relating to the Software or these Terms is limited to the fees you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limits, in which case the limits apply as far as the law permits.

12. Indemnity

You will defend and reimburse us for claims, losses and costs arising from your broadcasts or content, your breach of these Terms, or your violation of any law or third party's rights.

13. Governing Law & Disputes

These Terms, and any dispute arising out of or relating to them or the Software, are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules.

Try to resolve it first. Before starting any legal proceeding, you and we will try in good faith to resolve the dispute informally. To begin, email info@atmodeck.com with a short description of the problem and what you are asking for. If it is not resolved within 30 days, either of us may go to court.

Courts. Subject to the next paragraph, any legal action must be brought in the state or federal courts located in Missouri, and you and we each consent to the jurisdiction of and venue in those courts.

Protecting the Software. Nothing in this section stops us from asking any court that has jurisdiction for an order to prevent or stop unauthorized use, copying, modification or distribution of the Software, or a breach of section 4 or 5, and no advance notice or waiting period is required before we do so.

General. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms are the entire agreement between you and us about the Software and replace any earlier agreement about it. If we do not enforce a right right away, we have not given it up.

14. Changes

We may update these Terms from time to time. We will post the updated Terms with a new "last updated" date, and where a change is material we will make reasonable efforts to notify subscribers. Continued use of the Software after a change constitutes acceptance of the updated Terms.
